Welcome to 'DORPLAY' ("App"), a prepaid subscription service offered by Streambox Media Pvt. Ltd. ("SMPL", "we", "us" and "our"), which enables users only in India ("you" and "your") to access and use multiple OTT apps and live channels via a single app only on a single mobile device with single sign-on.
These Terms of Use ("Terms") and the Privacy Policy (collectively referred to as "Agreement") govern the access to and use of the App. Please read the Agreement carefully before accessing and using the App. If you do not agree with the provisions of the Agreement, please do not access and use the App. By accessing and using the App, you agree to be bound by this Agreement.
This Agreement is an electronic record in accordance with the Information Technology Act, 2000 and rules thereunder (as amended). It is generated by a computer system and does not require any physical or digital signatures.
You must be at least 18 years of age (or above 21 years of age, where a guardian is appointed as per the Majority Act of 1875) to access and use the App. Minors may access and use the App under the supervision of parent(s) or guardian(s), who have subscribed to the App.
a. The App services are offered through prepaid subscription plans. Details of available plans, including pricing and subscription period, are provided on Flipkart's app or website and our website and/or the App. Such subscription period commences from the date of purchase of the subscription coupon code.
b. SMPL reserves the right, at its sole discretion, without prior notice to you and without any liability whatsoever to SMPL, to:
(i) Add, delete, modify, suspend, or discontinue OTT Apps and/or television channels forming part of the subscription plans.
(ii) Change pricing of the subscription plans. Such changes shall not impact your current subscription plan but shall be applicable only upon renewal.
(iii) Modify or discontinue subscription plans. Such modification or discontinuation shall not impact your current subscription plan but shall be applicable only upon renewal.
c. The subscription fees are non-refundable, and no credits or refunds shall be provided for unused subscription period.
a. Subscription Activation and Registration:
(i) Download the App on your mobile device and view the features of the App on your mobile device.
(ii) To access and use the services forming part of the App, purchase a subscription coupon code from Flipkart's app or website.
(iii) After purchase, a subscription coupon code will be displayed on Flipkart's app or website.
(iv) Enter the subscription coupon code and OTP generated on your registered mobile number to activate your account on your mobile device.
(v) Upon activation, the App will prompt you to answer a few questions to complete registration. Ensure the information provided during registration is accurate and up-to-date.
(vi) Once registration is complete, you can access the content via the App for the validity of the subscription plan.
b. Subscription Renewal:
(i) For continued access and usage of the App, prior to expiry of the current subscription, purchase a new subscription coupon code from our website -- www.dorworld.in.
(ii) Renew your subscription by entering the new subscription coupon code and OTP generated on your registered mobile number on the App.
(iii) If the subscription is not renewed prior to the expiry of the current subscription period, your access and use of the App shall cease at the end of the current subscription period.
c. Subscription Coupon Code Activation Attempts: You are allowed a maximum of five (5) attempts to activate the subscription coupon code within a 24 hour period. If you enter the wrong subscription coupon code five (5) times, further activation attempts will be restricted for the next 24 hours. After the 24 hour restriction period, you can attempt activation again. SMPL will not be responsible for any delays in accessing the services forming part of the App due to incorrect subscription coupon code entries.
d. Mobile Number Policy: Your subscription to the App and access and use of the services forming part of the App is linked to your registered mobile number and therefore, your registered mobile should be the same during the subscription period.
a. The usage of the App is restricted to (i) personal and non-commercial purposes, (ii) one mobile device only, and (iii) the territory of India only. Unauthorized sharing, distribution, or commercial use is prohibited.
b. The App provides access to OTT apps and live channels owned and operated by third-party content providers. The contents on such OTT apps and live channels are provided on an "as is" basis. Each such third-party content providers are solely responsible for such content, including its compliance with applicable laws, classifications, ratings, descriptions and any other related information.
c. SMPL is not responsible for:
(i) The quality, accuracy or availability of such OTT apps and live channels and the contents thereof by third-party content providers.
(ii) Any such content-related grievances should be directed to the grievance officer of respective third-party content providers.
(iii) Any activity happening under your account, whether authorized or not.
d. Access to such content are subject to additional terms of use and privacy policy of such third-party content providers.
a. You agree to use the App in compliance with all applicable laws and the provisions of this Agreement.
b. SMPL reserves the right to suspend or terminate your account for violation of applicable laws and the provisions of the Agreement.
a. All content on the App, including text, graphics, logos, and software, is the property of SMPL or third-party content providers or their licensors and is protected under applicable intellectual property laws.
b. You are granted a limited, non-exclusive, non-transferable license to access and use the App for personal purposes only. You must not reproduce, distribute, or create derivative works.
a. By using the App, you agree to our Privacy Policy and the privacy policies of such third-party content providers, which governs the collection, use, and sharing of your personal information. By providing us your mobile number, you agree and provide us your explicit consent to receive relevant information (including promotional or transactional) from us. In case you are registered under DND, this consent of yours shall be deemed to be an exclusion from the DND services.
b. Few personal information collected during subscription registration may be shared with third-party content providers for activation of OTT apps owned and/or operated by such third-party content providers and forming part of the App. Such personal information shall also be governed by the privacy policies of OTT Apps owned and/or operated by such third-party content providers.
a. The App is provided "as is" and "as available". SMPL disclaims all warranties, express or implied, including those of merchantability and fitness for a particular purpose.
b. SMPL does not guarantee uninterrupted or error-free access to the App and the contents thereof.
You agree to indemnify and hold harmless SMPL, its affiliates, and its officers, directors, employees, and agents from any claims or damages arising from:
a. Your breach of the applicable laws and this Agreement.
b. Your violation of third-party rights.
a. SMPL shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.
b. SMPL’s total liability shall not exceed the amount paid by you for your last subscription.
SMPL reserves the right to amend the provisions of this Agreement from time to time. Updated Agreement will be posted on the App. Continued use of the App constitutes acceptance of the updated Agreement.
a. Waiver: SMPL’s failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision or right.
b. Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
c. Force Majeure: SMPL shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, or government actions.
d. Governing Law and Dispute Resolution: This Agreement is governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi.
e. Entire Agreement: This Agreement constitutes the entire agreement between you and SMPL regarding the use of the App and supersedes any prior agreements.
