Welcome to ‘DOR’ (as defined below) and ‘DOR TV’ (as defined below) a subscription service offered by Streambox Media Pvt. Ltd. (“Streambox”, “we, “us” and “our”). These Terms of Use ("Terms") govern the access to and use of DOR by user (“you” and “your”) exclusively on DOR TV and DOR TV App (as defined below). By accessing or using DOR, DOR TV and DOR TV App, you agree to be bound by these Terms and the Privacy Policy (collectively referred to as “User Agreement”).

Please read the User Agreement carefully before accessing and using DOR and DOR TV. If you do not agree to the provisions of the User Agreement, please do not access and use DOR and DOR TV and forthwith return DOR TV to Streambox.

This User Agreement is an electronic record in accordance with the Information Technology Act, 2000 and rules thereunder (as amended). It is generated by a computer system and does not require any physical or digital signatures.

1. Definition

In this User Agreement, the following terms shall have the meaning as ascribed to them below:

(a) “Activation Fee” means the initial pre-paid fee payable by you for subscribing DOR and DOR TV (which includes the Subscription Fee for the period specified on our website). The Activation Fee is published on our website and will depend on the size of DOR TV subscribed by you.

(b) “DOR” means a subscriotion service made available to you by Streambox, wherein you have access to multiple OTT Apps, television channels and games curated and packaged by Streambox with single subscription.

(c) “DOR Activation Date” means the date from which DOR gets activated on your DOR TV.

(d) “DOR Store” means an-inbuilt app store on DOR TV to download, install and access the Third Party Apps.

(e) “DOR TV App” means our companion mobile application, where DOR is made available to you by Streambox on complementary basis provided you have subscribed to DOR on DOR TV.

(f) “DOR TV(s)” means our smart screens of different sizes, which has an inbuilt DOR operating system, without which DOR cannot be accessed or used.

(g) “Initial Term” means the initial subscription period of DOR and DOR TV as specified on our website.

(h) “Subscription Fees” means the pre-paid fees payable by you for renewing the subscription of DOR and DOR TV before the expiry of each subscription period. The Subscription Fees are published on our website and will depend on the size of DOR TV subscribed by you.

(i) “Third Party Apps” means third party apps forming part of DOR Store but not part of DOR.

2. Eligibility

DOR and DOR TV are available to individual residing in India, who is at least 18 years of age (fully competent under law to enter into an agreement) (or above 21 years of age, where a guardian is appointed as per the Majority Act of 1875) (“Age of Majority”). By using DOR and DOR TV, you represent and warrant that you meet this requirement. If you are under the Age of Majority at the time of accessing and/or using DOR and DOR TV, your access and usage of DOR and DOR TV will be deemed to be subject to parental/legal guardian consent and under parental/legal guardian’s guidance at all times. Under such circumstances, this User Agreement will constitute a legally binding agreement between Streambox and your parents/guardians, who are contracting on your behalf.

3. Grant of Rights

Subject to you agreeing to the terms and conditions of this User Agreement and you paying in advance (a) applicable Activation Fee and (b) applicable Subscription Fees for the balance period of the Initial Term, you are granted a limited non-transferable and non-exclusive right to access and use DOR and DOR TV in India for the Initial Term only via DOR TV and/or DOR TV App for personal and non-commercial use. For continued access and use of DOR and DOR TV beyond the Initial Term, you need to renew your subscription and pay the applicable Subscription Fees prior to the expiry of each subscription period.

4. DOR and DOR TV

(a) DOR and DOR TV is a pre-paid subscription service. Hence, you must pay the applicable Activation Fee and applicable Subscription Fees in advance.

(b) The applicable Activation Fee and the applicable Subscription Fees are determined by Streambox and published on its website.

(c) In order to subscribe DOR and DOR TV, you must visit our third party vendor(s) website or app or any other options provided by Streambox and pay the applicable Activation Fee to our third party vendor. All such payments need to be made online/digitally; cash, cheques or any other form of payments are not accepted.

(d) While subscribing DOR and DOR TV, you need to provide (i) your name and address for billing, (ii) your registered mobile number for activation of DOR on DOR TV, (iii) the address where DOR TV needs to be delivered and installed and (iv) such other information or documents as may be prompted by our vendor’s website or app.

(e) Streambox reserves the right to add or delete or modify, suspend, or discontinue OTT Apps and/or television channels and/or games forming part of DOR at its sole discretion, without prior notice to you and without any liability whatsoever to Streambox. You specifically agree that no refunds, credits, or compensations will be owed to you due to such changes.

(f) You must always use DOR TV in conjunction with DOR and must comply with all instructions provided by Streambox.

(g) In order to receive uninterrupted DOR on DOR TV, you must ensure adequate incidental services, including internet supply and power supply. Streambox will not be liable if such incidental services are inadequate or faulty.

(h) The resolution or quality of the content on DOR is dependent on your internet speed/bandwidth. Streambox will not be responsible for your inability to receive proper resolution or quality due to poor or inadequate internet speed/bandwidth.

4. DOR and DOR TV

(a) DOR and DOR TV is a pre-paid subscription service. Hence, you must pay the applicable Activation Fee and applicable Subscription Fees in advance.

(b) The applicable Activation Fee and the applicable Subscription Fees are determined by Streambox and published on its website.

(c) In order to subscribe DOR and DOR TV, you must visit our third party vendor(s) website or app or any other options provided by Streambox and pay the applicable Activation Fee to our third party vendor. All such payments need to be made online/digitally; cash, cheques or any other form of payments are not accepted.

(d) While subscribing DOR and DOR TV, you need to provide (i) your name and address for billing, (ii) your registered mobile number for activation of DOR on DOR TV, (iii) the address where DOR TV needs to be delivered and installed and (iv) such other information or documents as may be prompted by our vendor’s website or app.

(e) Streambox reserves the right to add or delete or modify, suspend, or discontinue OTT Apps and/or television channels and/or games forming part of DOR at its sole discretion, without prior notice to you and without any liability whatsoever to Streambox. You specifically agree that no refunds, credits, or compensations will be owed to you due to such changes.

(f) You must always use DOR TV in conjunction with DOR and must comply with all instructions provided by Streambox.

(g) In order to receive uninterrupted DOR on DOR TV, you must ensure adequate incidental services, including internet supply and power supply. Streambox will not be liable if such incidental services are inadequate or faulty.

(h) The resolution or quality of the content on DOR is dependent on your internet speed/bandwidth. Streambox will not be responsible for your inability to receive proper resolution or quality due to poor or inadequate internet speed/bandwidth.

5. Change of Registered Mobile Number & Change of Installation Address

(a)Your subscription to DOR is linked to your registered mobile number and therefore, the mobile number should be the same for the Initial Term, post which if you intend to change your mobile number, please contact our customer service team at least fifteen (15) days prior to such change to enable Streambox to change your registered mobile number linked to all services forming part of DOR.

(b) After the Initial Term, if you intend to change your installation address, please contact our customer service team at least fifteen (15) days in advance.

6. Installation & Setup

(a) Upon receipt of the applicable Activation Fee from you, Streambox will endeavour to deliver DOR TV at the installation address specified by you at the time of payment within two (2) days (if within municipal/town limits) and three (3) days (if outside municipal/town limits) from the date of payment of such applicable Activation Fee.

(b) Subject to Clause 6(a) above, Streambox will make reasonable efforts to arrange for its engineer to undertake installation at the address, date and time requested by you. The installation will be done in your presence or the presence of your authorized representative.

(c) You will be required to take any permission that may be required for installation (including access to common space, if required).

(d) You agree to provide our engineer with reasonable access to your premises to perform such installation.

(e) Streambox will not separately charge you for installation of DOR TV. However, the charges for third party service providers (like electrician) will be borne by you. Further, any additional installation requirements or custom setup beyond the standard installation may incur additional charges, which will also be borne by you.

(f) To access DOR, you need to create an account via DOR TV by using your registered mobile number and the OTP generated on such mobile number.

7. DOR TV App

(a) While access to DOR via DOR TV is available upon payment of the applicable Activation Fee and the applicable Subscription Fees, access to DOR via DOR TV App is complementary, provided you have your subscription on DOR TV active.

(b) In order to access DOR via DOR TV App, you need to download DOR TV App from App Store (ios) or Play Store (android) on your smart phone with the registered mobile number and activate your account via DOR TV App by using your registered mobile number and the OTP generated on such mobile number.

8. Renewal, Suspension, Reactivation and Deactivation

(a) At the time of installation, you will have the option to create standing instructions for auto renewal of your DOR and DOR TV subscription. If you opt for standing instructions, the Subscription Fee will get automatically debited at the time of renewal ensuring uninterrupted access to DOR on DOR TV and DOR TV App. If you chose not to create such standing instructions, you will need to manually renew your subscription before the expiry of each subscription period (“Due Date”). Various renewal methods will be communicated on our website and other official channels. All such payments need to be made online/digitally; cash, cheques or any other form of payments are not accepted. Streambox will not be responsible for any failed transaction or interruptions caused due to issues with the standing instructions or payment methods.

(b) After the Initial Term, Streambox reserves the right to increase or decrease the applicable Subscription Fees at its sole discretion, without prior notice to you and without any liability whatsoever to Streambox.

(c) If the subscription is auto-renewed or manually renewed and the applicable Subscription Fees is paid within the Due Date, your access to DOR will continue on DOR TV and DOR TV App.

(d) If, however, the subscription is not renewed and the applicable Subscription Fees is not paid within the Due Date, your access to DOR will be suspended both on DOR TV and DOR TV App.

(e) Streambox will give you such number of days from the Due Date as specified in our website to renew the subscription and pay the applicable Subscription Fees (“Grace Period”).

(f) If the subscription is renewed and the applicable Subscription Fees is paid within the Grace Period, your access to DOR will get reactivated. Upon reactivation, Streambox may deduct the expenses, charges and/or penalties that Streambox may deem fit.

(g) If the subscription is not renewed and the applicable Subscription Fees is not paid even within the Grace Period, your access to DOR will be deactivated and this User Agreement will stand terminated on the deactivation date.

(h) Upon deactivation of DOR and termination of this User Agreement, you will forthwith return DOR TV to Streambox. Our customer service team will contact you on your registered mobile number and guide you through DOR TV return procedure.

9. Cancellation

(a) You will not be entitled to cancel your DOR and DOR TV subscription within the Initial Term. Any time after the Initial Term, you may elect to cancel your access to DOR and DOR TV.

(b) Upon cancellation of DOR and DOR TV subscriptions, this User Agreement will automatically stand terminated and you will forthwith return DOR TV to Streambox. Any refund requests post such cancellation shall be subject to Streambox’s policies. Our customer service team will contact you on your registered mobile number and guide you through DOR TV return procedure and the refund policy.

10. Offer to buy your DOR TV

(a) DOR TV is not sold but is made available to you by Streambox. All rights, title, interest and ownership of DOR TV will at all times continue to solely and exclusively vest with Streambox.

(b) However, any time after the Initial Term, subject to your continued subscription of DOR and DOR TV during such Initial Term, you may buy your DOR TV at a nominal price published on our website.

11. Warranty

(a) Subject to your continued subscription of DOR and DOR TV, DOR TV is warranted against defects in materials and workmanship under normal use for a period of four (4) years from DOR Activation Date (“Warranty Period”).

(b) During the Warranty Period, if a defect arises and a valid claim is made by you, Streambox will, at its option, either repair DOR TV at its own cost or exchange DOR TV with a same sized working DOR TV. Such warranty will only cover manufacturing defects (including faulty components or assembly errors, etc.), mechanical/electronic breakdowns (including power supply, malfunctioning circuitry or panel defects, etc.), parts and labour. It is clarified that such warranty will not cover unauthorised modifications i.e., alterations without manufacturer approval etc., cosmetic damages, accidental damages including but not limited to misuse, mishandling, physical impact, liquid spill etc.

(c) To make a warranty claim, please contact our customer service team. You need to provide proof of delivery of such DOR TV, describe the problem in detail, and follow any further instructions provided by our customer service team. If complaint lodged before 1 pm, subject to validation of such complaint by Streambox, Streambox will endeavour to address the complaint within two (2) days (if within municipal/town limits) and three (3) days (if outside municipal/town limits). However, in case of unavailability of spares (if applicable), Streambox may take additional number of days to address the complaints.

(d) Post the Warranty Period, you will be liable to pay all applicable charges for such repairs or replacement as determined by Streambox from time to time.

12. DOR TV and DOR Store

(a) DOR TV may also be used as a device to access services of the Third Party Apps.

(b) If you have already subscribed to the Third Party Apps, you may download and install the Third Party Apps from DOR Store on DOR TV and access the Third Party Apps on DOR TV.

(c) If you have not subscribed to the Third Party Apps, you may download and install the Third Party Apps from DOR Store on DOR TV, pay the subscription fees (if applicable) directly to the owners and/or operators of the Third Party Apps and access the Third Party Apps on DOR TV.

(d) It is made abundantly clear that you will be able to access the Third Party Apps on DOR TV only if (i) your subscription of DOR and DOR TV is active, and (ii) your subscription of the Third Party Apps (if applicable) is active.

13. Your Obligations

(a) You will not use DOR for any unlawful or immoral purposes including that are in violation or derogation of any law or for any purposes which are against any public policy or for sending/receiving obscene, threatening, harassing messages/ communications or sending messages or communications that affect national interest, or result in damaging or risking Streambox or other users of DOR. You will be solely responsible for all such acts or omissions. You agree to accept responsibility for all activities that occur under your account.

(b) You undertake to return DOR TV immediately to Streambox upon disconnection or cancellation of DOR and DOR TV subscription for any reason whatsoever. You will not claim any interest, charge or lien on DOR TV, even if any dispute is pending for resolution between you and Streambox.

(c) You agree not to make, publish, or otherwise disseminate any statements, comments, or materials that disparage, defame, or otherwise negatively impact the reputation or goodwill of Streambox, its affiliates, officers, directors, employees, or agents. This prohibition includes, but is not limited to, statements made through social media, online forums, blogs, reviews, or any other form of public or private communication.

14. Your Representation & Warranties

You acknowledge, agree and undertake that:

(a) the documents/details submitted by you are subject to clearance/acceptance by Streambox. In case of non-acceptance/rejections of documents, the refund, wherever applicable, will be made as per Streambox refund policy.

(b) You are fully conversant with DOR and DOR TV provided by Streambox together with its charges, specification, requirements, limitations, etc., and you have agreed to this User Agreement with complete understanding of the terms and conditions and of your obligations.

(c) You will comply with all applicable laws, including rules, regulations, orders, directions, notifications, etc., of the Government/Court/tribunals and will also comply with all the directions issued by Streambox related to DOR, DOR TV, DOR TV App or connected matters and will provide to Streambox all information and co-operation as may be required by Streambox (from time to time). Streambox disclaims any responsibility for your compliance with such laws.

(d) You agree to use DOR and DOR TV in compliance with all applicable laws and regulations. In addition to compliance of the User Agreement, you undertake to review and comply with the terms of use and privacy policy of all OTT Apps, television channels and games forming part of DOR and the Third Party Apps.

15. Intellectual Property

The contents available on DOR and the Third Party Apps are protected by copyright, trademark and other intellectual property laws. You will not reproduce, modify, create derivative works based on such contents or publicly display any content from DOR and the Third Party Apps.

16. Privacy & Data Protection

Privacy of communication is subject to the terms of the Privacy Policy on our website (www.dorworld.in/privacy). You grant express consent to Streambox to collect, use, share and/or retain your personal information, and contact you for all purposes..

17. Content Disclaimer

(a) Streambox merely aggregates and distributes OTT Apps, television channels, and games owned and operated by third party service providers. Streambox has no control over the contents on such OTT Apps, television channels, and games. Each such third party service providers are solely responsible for the content it provides, including its classification, descriptions and any other related information. Streambox does not endorse or assume responsibility for accuracy, legality or quality of such content. By using DOR and the Third Party Apps on DOR TV and/or DOR TV App, you expressly relieve Streambox from any and all liabilities arising from your access and use of such OTT Apps, television channels and games on DOR and the Third Party Apps.

(b) If you wish to register any complaint with respect to the content of any such third party service provider, kindly reach out to our Grievance Officer, Mr. Deepak Raorane at contentgrievance@dorworld.in. Please ensure that your e-mail clearly states (i) your name, (ii) name of the third party service provider, show/programme, and series/episode number, and (iii) details of the complaint. Streambox will acknowledge your e-mail, direct your complaint to such third party service provider and facilitate redressal as per applicable laws. Alternately, you may directly register the complaint with the grievance officer of such third party service provider, whose details are available in the terms of use of such third party service provider.

(c) You are solely responsible and liable for all content that you may upload, post, or transmit via DOR and the Third Party Apps. Streambox is not responsible for any content created or provided by users and disclaims all liability related to user-generated content.

18. Disclaimer, Indemnity & Limitation of Liability

(a) Streambox will use reasonable endeavours to maintain the maximum possible uptime of DOR. However, Streambox cannot guarantee that DOR will be fault free without interruption, disruption or downtime. Streambox will not be liable to refund any amount to you or compensate you for any such interruption, disruption or downtime.

(b) Streambox reserves the right, without notice or any liability whatsoever to you, to interrupt, suspend, cancel, modify, or terminate any services (or part thereof) supplied to you, if such action is deemed necessary by Streambox (i) under any law or is directed by any government, enforcement or competent agency/authority; (ii) for technical, maintenance, testing, security or failure or degradation of any facilities, equipment or systems used to provide DOR; (iii) to combat any acts of piracy, fraud or misuse of DOR; (iv) due to any act beyond the control of Streambox; (v) for any legitimate business purpose; or (vi) for safeguard security and integrity of DOR; or (vii) for reasons of threat to national interest, or in the event of emergency, such as, war or similar situation or if DOR or content is anti-national, promotes political / religious propaganda, against public policy, banned or restricted from being distributed under any applicable laws or Streambox otherwise determines that it is objectionable or obscene or derogatory to any person or class of persons or hurts the religious sentiments of any religious group or infringes the privacy rights of any individual or is not in the interest of the subscribers or the general public. Streambox reserves the right to terminate or suspend your access to DOR, in whole or in part, at its sole discretion, for any reason whatsoever, without any prior notice. Such termination or suspension will not entitle you to any refunds or credits.

(c) Without prejudice to the foregoing, Streambox reserves the right to suspend or deactivate DOR for any reason whatsoever, including your failure to comply with this User Agreement or making unauthorised use of DOR and/or Third Party Apps, conducting piracy through DOR or if mandated by the law. In addition to such suspension or deactivation, Streambox will have the right to exercise all other rights and remedies available to Streambox against you under applicable laws.

(d) Streambox reserves the right to recover the cost of DOR TV from you and/or claim damages from you if DOR TV is (i) stolen or lost, (ii) damaged, or (iii) not returned even after deactivation, cancellation or expiry of the subscription of DOR and DOR TV.

(e) DOR and/or DOR TV is provided ‘as is’ and ‘as available’ without warranties of any kind, express or implied. Streambox does not guarantee the accuracy, reliability or availability of DOR (including the contents and services of third party service providers forming part of DOR). Streambox and its affiliates, officers, employees, agents, partners, and licensors will not be liable for any direct or indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use DOR and/or DOR TV; (ii) unauthorized access to or alteration of your transmissions or data; or (iii) any other matter related to DOR and/or DOR TV.

(f) You agree to defend, indemnify and hold harmless Streambox its affiliates, its parent company, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to DOR and/or DOR TV and/or Third Party Apps, your violation of any term of this User Agreement or any third party right, including, without limitation, any copyright, property, or privacy right. The indemnification obligation will survive the termination of this User Agreement or the usage of DOR and/or DOR TV and/or Third Party Apps by you.

(g) You waive any right to participate in a class action or seek any form of collective redressal. In the event of any dispute or issue with DOR and/or DOR TV, your sole and exclusive remedy shall be limited to a refund of the subscription fee paid for the period during which the issue occurred, if any. Streambox’s liability is limited to this remedy and shall not exceed the total amount paid by you for DOR and/or DOR TV during the affected period. To the extent permitted by law, you waive any and all claims or causes of action that you may have against Streambox including, but not limited to, related to or arising from any perceived inadequacy, malfunction, or failure of DOR and/or DOR TV, any issues related to content, including user-generated content or third-party content accessed through DOR and/or DOR TV and/or Third Party Apps, and any claims related to the termination or suspension of your access to DOR and/or DOR TV and/or Third Party Apps, regardless of the cause or notice provided. To the extent permitted by law, you agree that any claim or cause of action arising out of or related to this User Agreement or DOR and/or DOR TV and/or Third Party Apps must be notified to Streambox in writing and be filed within fifteen (15) months after the claim or cause of action arises or otherwise the same shall stand barred.

19. Miscellaneous

(a) Confidentiality: Neither you nor any person through you shall disclose or make available to any third party any information relating to the operations or the business of Streambox or its group companies, their affiliates, their representatives/officers. Neither you nor any persons related to you shall make any statements of any nature including without limitation statements relating to Streambox or its group companies, their affiliates, their representatives/officers or its operations, its activities, to any third party or the press or any media company(ies)/service. Violation of this obligation shall immediately result in the discontinuation of DOR. Streambox further reserves the right to take action against you or such other persons as deem fit by Streambox including initiate legal action against such violation of this clause.

(b) Assignment: This User Agreement cannot be transferred or assigned by you but may be delegated or assigned (in part or whole) by Streambox to any third party without restriction and/or consent.

(c) Waiver: The failure of Streambox to enforce any right or provision of this User Agreement will not be considered a waiver of those rights.

(d) Severability: If any provision of this User Agreement becomes invalid, illegal or unenforceable, in whole or in part, the validity of the remainder provisions of this User Agreement will not be affected thereby.

(e) Relationship: This User Agreement is on a ‘principal to principal’ basis and the parties are independent of each other. Nothing contained herein is intended to or shall be deemed to create any partnership, joint venture, employment or relationship of principal and agent between the parties or provides either with any right, power or authority, whether express or implied to create any such duty or obligation on behalf of the other party.

(f) Force Majeure: Streambox shall not be responsible or liable in any way for the failure or delay or any interruptions in the performance of its obligations due to Force Majeure. If Force Majeure persists, Streambox shall be entitled to terminate this User Agreement on written notice. You shall remain liable for all charges during any such disruptions, unless decided otherwise by Streambox.

(g) Notices: All notifications, complaints and notices must be in writing and addressed to Customer Operations, Streambox Media Private Limited, at its registered address or otherwise as specified by the customer service team. Any notification, complaints and notices given by you shall be deemed to have been delivered to Streambox when it is received by Streambox. You could also call the customer care team to seek information or register any complainant. Calls from your Registered Mobile Number(s) will be identified by the customer service team however identification verification may be sought. You agree to provide true, accurate, current and complete information about you and your subscription. Streambox will endeavor to handle and resolve all your queries and complaints through its customer service team. You agree that notifications provided by Streambox in any format will be sufficient and adequate notice to you.

(h) Governing Law, Jurisdiction & Waiver/Limitations: The rights and obligations of the Parties under this User Agreement shall be governed by and construed in accordance with the laws of India. Courts in Delhi, to the exclusion of all other courts, shall have exclusive jurisdiction in respect of any dispute between the Parties arising out of or in connection with or as a result of this User Agreement.

(i) Entire Agreement: This User Agreement contains the entire understanding between the Parties regarding your use of DOR and DOR TV.

20. Changes to the User Agreement

Streambox reserves the right to modify or replace the User Agreement at any time without notice. It is your responsibility to regularly review the User Agreement for any changes. If a revision is material, Streambox may notify you via DOR or by any other means. What constitutes a material change will be determined at sole discretion of Streambox. Your continued use of DOR and DOR TV after such changes constitutes your acceptance of the new User Agreement.
